Effective Sep 2008.

All web site design will remain the property of De Bru PC until paid for in full. De Bru PC transfer ownership of the website design and all Intellectual property rights over to the client upon final payment.

Intellectual property rights - any intellectual property rights generated for a De Bru PC client, including, but not limited to trademarks, drawings, diagrams, design, artwork, photographs, digital photographs, Standard HTML, ASP code, database coding and JavaScript, work manipulated on behalf of a De Bru PC client, work commissioned by a De Bru PC client, passwords, access codes, & flash code specific to the De Bru PC clients web site, will remain the property of De Bru PC.

All website content is to be provided by the client, and no responsibility is taken by De Bru PC for any images or text displayed on the website, that subsequently has existing copyright associated with it, that may cause grievance with the original owner. All images supplied must be in a standard GIF, PSD, PNG or JPG format and must be able to be read in Adobe Photo shop or Adobe Fireworks. Any images or photographs supplied by De Bru PC will be provided and sourced from what we believe to be reputable sources in good faith. Any infringement of copyright resulting from this will be the responsibility of the client.

De Bru PC reserve the right to charge Late Payment Interest, on all overdue invoices.This will be calculated at the daily rate.

Any hosting space for the website, reserved for the client, will remain the property of De Bru PC.

De Bru PC cannot be held responsible for any virus that may be passed on to any computer from the web server, or by email.

De Bru PC cannot guarantee web server security, and cannot be held responsible for any loss, or misuse by third parties, of any data that is captured and/or stored on the web-server, even using SSL encryption.

De Bru PC will register all clients' websites with some search engines, but cannot guarantee inclusion, and/or rankings within any of these search engines. It is the responsibility of the client to register more regularly if required, unless specified on the order.

All prices quoted in any proposal are valid for 28 days from date of proposal. Project timescales quoted are an estimate only and cannot be guaranteed.

Prices do not include any hardware or software that may be required, unless specified on the order, and do not include any visits requested by the client to configure any hardware or software on the clients equipment. The price to purchase fonts specified by the client will be chargeable over and above any contracted development fee.

Prices do not include the cost of any merchant accounts required by the client for on-line credit card transactions.

De Bru PC will endeavour to host the web site on a 24 hours a day basis, through a partnership with a professional web hosting company, but cannot be held responsible for any downtime of the web server, or other equipment, connected to the Internet, which causes the clients web site to be off-line for any reasonable amount of time, or causes loss of revenue on an e-commerce enabled website. This is applicable to web site hosting and any email POP3 accounts and email forwarding.

De Bru PC will not be held responsible for any problems arising from the clients own email account and Internet service provider (ISP) and cannot be held responsible for any software or hardware problems on the clients equipment.

If a website is hosted by De Bru PC, The client will be one month of the total web site yearly fee & a signed contract. The remaining month fee will be invoiced each month from the website is completed and launched.

De Bru PC do not accept any responsibility for consequential loss incurred by any 3rd party as a result of the failure of any products or services supplied.

De Bru PC payment terms are within 7 days. The client agrees to pay an ongoing monthly fee. If the client wishes De Bru PC to maintain the site on an ongoing basis. This fee will be agreed separate to the monthly package fee. Also Re-registration of domain is renewable every two years. The ongoing monthly maintenance and support charges are effective from website launch date. One months written notice is required to terminate the contract. If the client terminates the contract with De Bru PC and the clients are required to pay the remained of the contract. If the client requires a copy of the site for future use, then a charge to be negotiated based on site complexity will be incurred by the client. Any sites using integration into our databases and web site admin systems cannot be supplied to the client as their functionality is dependent on integration into the De Bru PC systems. FTP access to servers will not be granted to clients in the interest of Data Security..

De Bru Pc reserves the right to remove the clients web site from the internet, and supend any Email services if the clients account is in arrears. . A  reconnection fee maybe incurred by the client which must be paid before services are restored. If no satisfaction has been gained in regards arrears or non payment the web site in question and all domain names and services purchased or arranged via De Bru Pc then all ownership of the previously mentioned will revert to De Bru Pc.

Domain names managed by De Bru PC remain the property of the client. De Bru PC will appear on the domain registry as the domain owner however this is for renewal payment purposes to ensure domains are renewed in a timely fashion. If a client cancels a maintenance/services and support contract with De Bru PC, the ongoing management of the domain name becomes the clients responsibility. If the client does not instigate the transfer of the domain to their own control then De Bru PC will assume that the client no longer requires the domain name and De Bru PC may assume ownership. Any domain names registered on behalf of the client will remain the property of De Bru PC unless the client requests in writing that the domain be transferred. De Bru PC will then follow the instructions of the client to transfer the domain out. A fee will be charged to cover administration and any outstanding charges for periods up to the request date must be paid before the domain name will be transferred..

If the web site that is hosted by De Bru PC on behalf of the client starts to exceed the stated bandwidth allowance by the third party hosting company, then De Bru PC will pass on any extra charge to the customer.

No illicit or pornographic material is allowed on any website hosted on behalf of De Bru PC. De Bru PC will inform the relevant authorities if any such material is discovered.

De Bru PC (www.debrupc.com) is a business based in Tenerife, Spain, and is therefore governed by Spanish law. This is still applicable for anybody who can view the web site in any other country, and / or has contact with De Bru PC by any other means of communication such as electronic mail, fax or post, without necessarily having viewed the web site (www.debrupc.com).

Once the web site has been placed live on the Internet, the client has the right to make any changes through De Bru PC, to the web site. After this period, the client is deemed to have accepted that the web site is satisfactory.

Data Protection.

De Bru PC protect all data held under the Data Protection Act 1984 & 2000. You consent to our use of any personal details you give us for our own internal administrative purposes, and for future marketing. Or Case Studies for sections on www.debrupc.com. No personal details will be included. If you give us fax, phone or e-mail details you authorise us to contact you using that method. If you decide that you no longer wish us to communicate with you, or the details we hold on you change, tell us to enable us to update our records. You agree that we may transmit data to your computer to store by means of cookies on your system.
